Rickey's point is, for better or worse, if you didn't fail at the time, according to the laws of most civilized places, you PASSED. Once tried, you should not be tried again for the same crime later, when situations have changed. Do folks get away with stuff- YES. But if they passed then they passed...period. You really CAN'T just 'say' "now we'll say they failed back then too".
But perhaps they should be monitored closely, and their peers as well.
