This is a response I got from the IPF yesterday after sending a letter back in the 1st of March.
Pretty timely response, wouldn't you say. LOL
I have affixed my resonse I sent back to them today. I hope I get a response back before 3 months this time.
I think it is pretty LAME trying to put this back on the USAPL at this time!!

Subject: Brian Siders: Mercy Petition

Dear Brian, dear Sherman,

I hope you both are and your families are well.

You have sent to the IPF-EC a petition of mercy. The EC has forwarded this petition of mercy for examining to the IPF Disciplinary Committee. The IPF-DC informed us:

The DC considers that it is the only body within IPF to examine and make decisions in cases that applies to rule-violations against Article 10.11 of the IPF Anti-Doping Rules. Therefore, although there is not a specific clause in the Anti-Doping Rules covering the situation where the original Judgments have been given, those not appealed to CAS, but the IPF has afterwards received the “petition letter” to reduce the period of suspension, the DC considers that the DC is the relevant and also the only body within IPF to make a further decision under these circumstances, and therefore accepts the request to re-examine the cases at hand.

The Disciplinary Committee decides that the sanctions imposed within 2006 to the lifters offending against Article 10.11 of the IPF Anti-Doping Rules shall remain as sentenced originally.

The IPF-EC has discussed your petition of mercy in light of this decision at their meeting in Denmark on 30. May 2007. We agreed to the decision of the IPF-DC and sorry for that, we cannot abort your suspension. So your suspension period expires on 18th of August 2007.

The IPF-EC recommends that you send a mercy petition to the USAPL-Executive Committee. Perhaps they are able to give you a “Wild card” for participating at the Women and Men’s World Championships in Austria 2007. But that decision must be taken by the USAPL-Executive Committee.

I hope this email finds everyone and their families healthy. Thanks for the efforts and time that you have given this matter. I heard over the last few months that the main reason that Brian’s suspension has been upheld and kept at 12 months is that a few IPF officials feel Brian competed with disregard to the IPF’s Rules. This is untrue!

Brian and I wanted to be sure the conditions by which Brain lifted would have IPF approval. “IPF approval” was and is important to Brain before he would attend any exhibition.

Brian Siders values his IPF legacy as his most coveted accomplishment.

He would not and DID NOT want to adversely affect this in any way.

To ensure IPF approval we went straight to the IPF President. We were sure the office of the President was the appropriate place to take up this issue. IPF President Norbert Wallauch gave us specific guidelines. We followed Mr. Wallauch’s guideline to the letter.

Below you will find a letter that I wrote to IPF President Mr. Norbert Wallauch, and his response.

These letters you will see below speak for themselves about Brian’s intentions.

(HE cc’d THIS RESPONSE WITH THE GUIDELINES TO THE IPF EC)

We insured Mr. Wallauch’s guidelines were followed. Copies of the IPF directive were provided to Meet Director Matt McCase. The guidelines supplied by the IPF President were followed exactly. We followed IPF directive exactly as written. We are unaware that anything was missed in translation. Brian Siders and all of us complied with each of the stipulations.

If Mr. Wallauch, the IPF President, did not have the authority to do provide these guidelines we should have been instructed to contact the people or committee that did have the authority.

Then a situation like this would NOT occur.

If these guidelines were not correct it is NOT Brian who is responsible for the error.

Brian Siders will miss two World Championships (2006,2007) because of this ruling.

In effect it is a TWO-Year suspension.

Can it be the suspension arises because he followed the directions of the IPF President??

The Ukraine and Russian teams with multiple failures over multiple years, and they are being brought back 6 months early to be able to compete in 2007 World Championships. How does this compare with the Suspension of Brian Siders? This is a travesty, especially after this rule (Article 10.11) has been changed in the past few months to a six-month period.

It is a travesty! Brain Siders exemplifies a true IPF lifter.

He is a record setting champion who is always willing to participate in drug tests.

Looking at the response I was sent yesterday, it appears that you, the IPF, are wanting the USAPL to fix this situation, which is literally impossible at this point in time.

I sent the above Mercy Petition on March 5th.

Why has it taken so long to get a response???

Thank you again for your time and efforts to resolve this unfortunate and unfair situation.

I look forward to the DC reviewing all the information provided herein.

With this information I trust the DC will now be able to make a reasonable and fair ruling for Brian Siders. I trust that a reply to this letter will be timely.
